Notice of Referendum Questions - WI DOJ's Explanation of a Yes or No

Dear County and Municipal Clerks,

The Wisconsin Department of Justice has issued a corrected explanatory statement to correct a minor error in Question 3 related to an incorrect legal citation. In turn, the WEC has updated the Type C Notice for the November 3, 2026 General Election to reflect WI DOJ’s correction. The updated notice is attached to this email and can be found on Type C Notice of Referendum November 3, 2026 | Wisconsin Elections Commission.

We do not believe this error will change voters’ understanding of the Type C Notice as it was limited to an incorrect legal citation. The error was in WI DOJ’s explanation of a yes or no vote in Question 3, where the original statement indicated that the referendum would impact Wis. Const. art. I, § 18, when the correct citation should read Wis. Const. art. I, § 27. The legal citation was correct in other areas of the original Type C Notice.

Please use the attached, updated version of the Type C Notice for posting at your polling places for the November 3, 2026 General Election.
